Resolution 53/2026/NQ-HĐND – swiftlet farming zones, Gia Lai Province

Pursuant to the Law on Organization of Local Government No. 72/2025QH15;

Pursuant to the Law on Promulgation of Legal Documents No. 64/2025/QH15 as amended and supplemented by Law No. 87/2025/QH15;

Pursuant to the Law on Animal Husbandry No. 32/2018/QH14, amended and supplemented by Law No. 146/2025/QH15;

Pursuant to Government Decree No. 13/2020/NĐ-CP providing detailed guidance on the amended and supplemented Law on Animal Husbandry, replaced by Decree No. 46/2022/NĐ-CP and Decree No. 32/2026/NĐ-CP;

Considering Proposal No. 685/TTr-UBND dated May 16, 2026, of the Provincial People's Committee on the draft Resolution on regulations regarding areas where animal husbandry is not permitted, and swiftlet farming zones in Gia Lai province; the Verification Report No. 93/BC-KTNS dated May 26, 2026, of the Economic and Budget Committee of the Provincial People's Council; and the discussion opinions of deputies of the Provincial People's Council at the session;

The People's Council promulgates the Resolution on regulations regarding areas where animal husbandry is not permitted, and swiftlet farming zones in Gia Lai province.

Article 1. Scope of regulation, applicable subjects

1. Scope of regulation

a) This resolution stipulates areas where livestock farming is not allowed and swiftlet farming zones in Gia Lai province as prescribed in point h, clause 1, Article 80 of the Law on Animal Husbandry No. 32/2018/QH14, amended and supplemented by clause 17, Article 3 of Law No. 146/2025/QH15.

b) This resolution does not apply to cases of keeping animals as pets, raising animals in laboratories without causing environmental pollution.

2. Subjects of application

a) State management agencies on animal husbandry.

b) Vietnamese organizations and individuals and foreign organizations and individuals involved in animal husbandry in the province.

Article 2. Areas where livestock farming is not allowed and swiftlet farming zones

1. Areas where livestock farming is not allowed are prescribed in the Appendix issued together with this Resolution.

2. Swiftlet farming zones are areas located outside the areas where livestock farming is not allowed as prescribed in clause 1 of this Article and at least 300 meters away from residential areas.

Article 3. Implementation provisions

1. This resolution takes effect from June 8, 2026.

2. The Provincial People's Committee shall organize the implementation of this resolution.

3. The Standing Committee of the People's Council, the committees of the People's Council, the delegations of the People's Council, and provincial People's Council deputies shall, within their respective tasks and authorities, supervise the implementation of this resolution.

4. Resolution No. 127/2020/NQ-HĐND dated July 9, 2020, of the Gia Lai Provincial People's Council (prior to reorganization), which stipulates that areas within the inner city of cities, towns, and townships, as well as residential areas, are not allowed to engage in livestock farming; and the region for swiftlet farming in Gia Lai province, shall cease to be effective from the effective date of this resolution.

5. Livestock facilities established and operating before the date of this Resolution

the effective enforcement applies to the area stipulated in Clause 1, Article 2 of the Resolution

This must be stopped or relocated to a suitable location.

6. For birdhouse farming establishments (swiftlet houses) that were operating before this Resolution came into effect but do not meet the provisions of Clause 2, Article 2 of this Resolution, they shall comply with the provisions at Point đ, Clause 2, Article 25 of Decree No. 13/2020/NĐ-CP detailing the Law on Animal Husbandry.

This Resolution was approved by the People's Council of Gia Lai Province, XIII term, 3rd session (specialized session) on May 29, 2026.
