RESOLUTION
Regulations on areas where breeding is not allowed, regulations on swiftlet breeding zones, and support policies when relocating breeding facilities out of areas
where breeding is not allowed in Tây Ninh province

Pursuant to the Law on Organization of Local Government No. 72/2025/QH15;
Pursuant to the Law on Animal Husbandry No. 32/2018/QH14;
Pursuant to the Law amending and supplementing a number of articles of 15 Laws in the field of agriculture and environment No. 146/2025/QH15;
Pursuant to Decree No. 13/2020/NĐ-CP dated January 21, 2020, of the Government providing detailed guidance on the Law on Animal Husbandry;
Pursuant to Decree No. 46/2022/NĐ-CP dated July 13, 2022 of the Government amending and supplementing a number of articles of Decree No. 13/2020/NĐ-CP dated January 21, 2020 of the Government providing detailed guidance on the Law on Livestock;
Pursuant to Decree No. 106/2024/NĐ-CP dated August 1, 2024 of the Government stipulating support policies to improve livestock efficiency;
Considering Proposal No. 3269/TTr-UBND dated July 10, 2026 of the Provincial People's Committee issuing a Resolution stipulating areas where livestock farming is not allowed, defining swiftlet farming zones, and policies to support the relocation of livestock establishments out of prohibited areas in Tây Ninh province; and Verification Report No. 837/BC-HĐND dated July 14, 2026 of the Economic - Budget Committee of the Provincial People's Council and the opinions discussed by Provincial People's Council deputies at the session;
The Provincial People's Council issues a resolution regulating areas where livestock farming is not allowed, stipulating swiftlet farming zones, and support policies for relocating livestock facilities out of areas where livestock farming is prohibited in Tây Ninh province.
Article 1. Scope of regulation and subjects of application
1. Scope of regulation
a) This resolution regulates areas where livestock farming is not allowed, stipulates swiftlet farming zones, and support policies for relocating livestock facilities out of areas where livestock farming is prohibited in Tây Ninh province.
b) This resolution does not apply to cases of keeping animals as pets or raising animals in laboratories that do not cause environmental pollution.
2. Subjects of application
a) Livestock facilities of organizations and individuals, both domestic and foreign, involved in livestock farming and swiftlet farming activities in Tây Ninh province.
b) State management agencies related to managing livestock and swiftlet farming activities in Tây Ninh province.
Article 2. Regulations on areas where livestock farming is not allowed in Tây Ninh province
1. Areas including streets, hamlets, and residential clusters, and residential lines according to the attached appendix.
2. Urban areas; residential areas; resettlement areas; clusters, residential lines; commercial housing areas; social housing areas; apartment areas; industrial zones, industrial clusters; economic zones; headquarters projects of Party agencies, State agencies, political organizations, socio-political organizations; public works; nature conservation areas; historical-cultural relic sites of special national, national, or provincial rank that have been classified; landscape protection areas that are already in existence, or have investment plans, or have been approved for detailed planning by the competent authority and whose plans have been publicly announced according to regulations.
Article 3. Regulations on swiftlet farming zones in Tây Ninh province.
1. Swiftlet farming area means an area outside the area specified in Article 2 of this Resolution.
2. The bird's nest house must have a distance of at least 300 m from the area specified in Article 2 of this Resolution.
3. Bird's nest houses must meet other provisions in Clause 2, Article 25 of the Government's Decree No. 13/2020/NĐ-CP dated January 21, 2020 detailing the Law on Animal Husbandry.
Article 4. Policies to support the relocation of livestock breeding establishments out of areas where livestock rearing is not permitted
1. Livestock breeding establishments must satisfy the following conditions:
a) Establishments raising cattle, poultry and other animals are permitted to raise livestock, except for bird's nest houses.
b) Livestock breeding establishments in areas where livestock farming is not permitted specified in Article 2 of this Resolution.
2. Principles of support
a) The state supports the cost of vocational retraining; a portion of the dismantling costs for relocation; and a portion of the costs for purchasing construction equipment and livestock technology equipment according to the existing barn area of the livestock facility subject to relocation.
b) Each facility eligible for support under this Resolution is only supported once by the provincial budget.
c) The support is provided after the livestock facilities cease operations in areas where livestock farming is not allowed, relocate to a new location, or cease operations and switch industries in accordance with regulations.
d) Not supported for livestock facilities built in areas where livestock farming is not allowed since Resolution No. 12/2020/NQ-HĐND dated July 9, 2020, of the People's Council of Long An province stipulates areas within the inner city of cities, towns, townlets, residential areas where livestock farming is not allowed, and swiftlet farming areas in Long An province, and Resolution No. 17/2021/NQ-HĐND dated December 9, 2021, of the People's Council of Tây Ninh province stipulates areas where livestock farming is not allowed and swiftlet farming areas in Tây Ninh province, which are effective until these Resolutions are replaced.
3. Content and level of support
a) Support 50% of the cost of purchasing construction equipment and livestock technology equipment according to the current barn area of livestock establishments subject to relocation; the maximum support level is 10 billion VND per establishment.
b) Support 50% of the cost of relocating livestock to a suitable new location; the maximum support is 500 million VND per facility.
c) Support 100% of training and retraining costs for transitioning from livestock farming to other occupations; the maximum support is 3 months of basic salary per person.
4. Implementation period: The support policy will be implemented for a period of 5 years from the effective date of this Resolution.
Article 5. Funding sources
1. State budget
a) Use public investment capital for the policies specified in point a, clause 3, Article 4 of this Resolution. The subjects using this public investment capital are other policy beneficiaries specified in clause 6, Article 5 of the Public Investment Law.
b) Use regular budget funds for the policies specified in clause 3, Article 4 of this Resolution, except for the cases of policies specified in point a of this clause.
2. Other legally mobilized funds in accordance with the law.
Article 6. Implementation organization
1. Assign the Provincial People's Committee to organize the implementation of this Resolution and to adjust or supplement the areas in the appendix issued with this Resolution if necessary or in case of changes in administrative boundaries, ensuring compliance with planning regulations, urban aesthetics, environmental protection, and epidemic safety.
2. Assign the Standing Committee of the Provincial People's Council, the Committees of the Provincial People's Council, delegation groups, and members of the Provincial People's Council to supervise the implementation of the Resolution.
3. Recommend that the Provincial Vietnam Fatherland Front Committee and provincial socio-political organizations propagate and participate in supervising the implementation of the Resolution.
Article 7. Implementation provisions
1. This Resolution takes effect from July 27, 2026.
2. This resolution replaces Resolution No. 12/2020/NQ-HDND dated July 9, 2020 of the Long An Provincial People's Council regulating areas within the inner city of cities, towns, townships, residential areas where livestock raising is not allowed, and swiftlet farming areas in Long An province, and Resolution No. 17/2021/NQ-HDND dated December 9, 2021 of the Tây Ninh Provincial People's Council regulating areas where livestock raising is not allowed and swiftlet farming areas in Tây Ninh province.
Article 8. Transitional provisions
1. For organizations and individuals who already have swiftlet houses that are not in the areas specified in Article 3 of this Resolution, the current state is maintained (relocation is not mandatory), expansion is not allowed, and the use of loudspeakers for broadcasting sound is not allowed.
2. For organizations and individuals who already have livestock facilities located in the areas specified in point b, clause 1, Article 4 of this Resolution, within 5 years from the effective date of this Resolution, they must cease operations or relocate to a suitable location.
This Resolution was adopted by the Provincial People's Council, 11th term, 5th session (mid-year regular session 2026) on July 17, 2026./.
