Resolution 38/2026/NQ-HĐND – swiftlet farming zones, Đà Nẵng City

Pursuant to the Law on Organization of Local Government No. 72/2025/QH15;

Pursuant to the Law on Promulgation of Legal Documents No. 64/2025/QH15 as amended and supplemented by Law No. 87/2025/QH15;

Pursuant to the Law on Animal Husbandry No. 32/2018/QH14, amended and supplemented by Law No. 146/2025/QH15;

Pursuant to Decree No. 78/2025/NĐ-CP dated April 1, 2025, of the Government detailing certain provisions and measures for organizing and guiding the implementation of the Law on Promulgation of Legal Documents, amended and supplemented by Decree No. 187/2025/NĐ-CP;

Pursuant to Decree No. 13/2020/NĐ-CP dated January 21, 2020, of the Government providing detailed guidance on the Law on Livestock, amended and supplemented by Decree No. 46/2022/NĐ-CP and Decree No. 32/2026/NĐ-CP;

Pursuant to Decree No. 106/2024/NĐ-CP dated August 1, 2024 of the Government stipulating support policies to improve livestock efficiency;

Considering Submission No. 235/TTr-UBND dated May 20, 2026, and Official Letter No. 4632/UBND-SNNMT dated May 28, 2026, of the City People's Committee regarding the draft Resolution stipulating areas where livestock farming is not allowed and swiftlet farming zones in Da Nang city; Verification Report No. 120/BC-DT dated May 28, 2026, of the Urban Committee of the City People's Council; and the opinions discussed by the members of the City People's Council at the session;

The City People's Council issued a Resolution stipulating areas where livestock raising is not allowed and zones for swiftlet farming in Da Nang city.

Article 1. Scope of regulation, applicable subjects

1. Scope of regulation

This Resolution stipulates areas where livestock raising is not allowed and zones for swiftlet farming in Da Nang city in accordance with point h, clause 1, Article 80 of the Law on Livestock No. 32/2018/QH14, amended and supplemented by Law No. 146/2025/QH15.

2. Subjects of application

a) Organizations and individuals, both domestic and foreign, engaged in raising livestock, poultry, and other animals according to the provisions of Law No. 32/2018/QH14, amended and supplemented by Law No. 146/2025/QH15, Decree No. 13/2020/NĐ-CP detailing the Law on Livestock, amended and supplemented by Decree No. 46/2022/NĐ-CP and Decree No. 32/2026/NĐ-CP (except for raising ornamental animals or animals in laboratories that do not cause environmental pollution) in Da Nang city.

b) People's Committees at all levels; agencies, organizations, and individuals related to livestock activities in Da Nang city.

Article 2. Regulations on areas where livestock farming is not allowed, swiftlet farming areas

2. Regulations on swiftlet farming areas

a) The swiftlet farming area is an area located outside the zones where raising livestock is not allowed as stipulated in clause 1 of this Article and outside the areas planned for national defense land, industrial land, and industrial clusters approved by the competent authority; at the same time, ensuring a minimum distance of 300 meters from the swiftlet house to residential areas and public works.

b) Swiftlet houses that were operational before the effective date of this Resolution but do not meet the regulations in point a, clause 2 of this Article must keep their current status, must not be expanded; loudspeakers must not be used to emit sounds.

Article 3. Implementation organization

1. The City People’s Committee shall organize the thorough understanding, propaganda, and implementation of this Resolution in accordance with the provisions of the law; at the same time:

a) Implement policies to support the relocation of livestock farms from areas where livestock raising is not allowed according to the provisions of Decree No. 106/2024/NĐ-CP dated August 1, 2024, of the Government on regulations on policies to support enhancing livestock efficiency; during the implementation process, regularly review and promptly submit to the City People's Council for consideration to issue relocation support policies (if necessary) and amend, supplement areas where livestock raising is not allowed, especially urban areas (wards), rural areas in communes oriented for development into wards, ensuring suitability with the actual situation in the locality.

b) Direct the implementation of digitizing the scope and boundaries of areas where livestock farming is not allowed, and swiftlet farming areas to serve management, supervision, and convenience in application by organizations and individuals.

c) Annually report the results of implementation to the City People's Council.

2. The Standing Committee of the City People's Council, the Committees of the People's Council, the delegations, and the deputies of the City People's Council shall supervise the implementation of this Resolution.

3. Recommend that the Vietnam Fatherland Front Committee of the city and city associations and unions, based on their functions and tasks, strengthen the work of propaganda, supervision, and mobilization of people to participate in supervising the implementation of the Resolution.

Article 4. Implementation provisions

1. The Resolution takes effect from June 10, 2026.

2. This resolution replaces Resolution No. 26/2022/NQ-HDND dated October 14, 2022, of the People's Council of Quảng Nam Province on regulations for areas within the inner city of cities, towns, townships, and residential areas where livestock farming is not allowed in Quảng Nam Province; Resolution No. 40/2022/NQ-HDND dated December 9, 2022, of the People's Council of Quảng Nam Province amending and supplementing Resolution No. 26/2022/NQ-HDND dated October 14, 2022, of the People's Council of the province on regulations for areas within the inner city of cities, towns, townships, and residential areas where livestock farming is not allowed in Quảng Nam Province; Resolution No. 31/2021/NQ-HDND dated September 29, 2021, of the People's Council of Quảng Nam Province on regulations for swiftlet farming zones in Quảng Nam Province; Resolution No. 34/2022/NQ-HDND dated July 14, 2022, of the People's Council of Da Nang City on regulations for areas within the inner city of the city and residential areas where livestock farming is not allowed; regulations on swiftlet farming areas and support policies when relocating farming facilities out of prohibited farming zones in Da Nang city.

3. This resolution abolishes Resolution No. 19/2023/NQ-HĐND dated September 22, 2023, of the People's Council of Quảng Nam Province, which stipulates the content and level of support when ceasing livestock activities in areas where livestock farming is not permitted in Quảng Nam Province, for the period 2023 - 2026.

4. In the event that villages or residential groups specified in this Resolution are changed according to the plan for arranging villages or residential groups, the scope of areas where livestock farming is not permitted shall remain according to the scope of the old villages or residential groups as previously issued, without the need to submit for immediate adjustment of the Resolution. The City People's Committee shall continue to review and consolidate for submission to the City People's Council for amendment in case of adjustment or addition of new areas.

5. In the event that the legal normative documents cited in this Resolution are amended, supplemented, or replaced by new documents, the provisions of the amended, supplemented, or replaced documents shall apply.
